Welcome to Taji Hijabs (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Services.
1) Eligibility & Your Responsibilities
You confirm you are of legal age to make purchases in your jurisdiction and will use the Services in compliance with applicable laws. You are responsible for ensuring that any products you buy are lawful to import, possess, and use in your location.
2) Accounts & Google Login
Creating an account is optional. If you use Google Login (OAuth), you authorize us to receive your name and email address from Google. You are responsible for securing your login. You may revoke Google access from your Google Account at any time.
3) Products, Colors & Sizing
Product images, colors, and descriptions are for general guidance only and may vary due to display settings, fabric batches, and manufacturing tolerances. We may change products, content, and pricing without notice.
4) Orders & Availability
All orders are offers to buy and are subject to acceptance and availability. We may cancel or refuse any order (for example, suspected fraud, pricing/stock errors, or restrictions). If we cancel after payment, we will refund the amount paid for the canceled item(s).
5) Pricing, Taxes & Duties
Prices are shown in the currency indicated at checkout and exclude/include taxes as stated there. You are responsible for any duties, customs, or import fees, where applicable.
6) Shipping & Risk of Loss
Estimated delivery times are guidelines only. Risk of loss transfers on delivery to the address you provide. We are not responsible for delays or failures caused by carriers, customs, weather, or circumstances beyond our control.
7) Returns & Exchanges
Return/exchange terms (if offered) are described on our Returns page or during checkout. Items must be returned in original condition and packaging as instructed. Where mandatory consumer rights apply, those rights prevail.
8) Promotions, Gift Cards & Store Credit
Promotions and gift cards are subject to their specific terms and may be changed, limited, or withdrawn at any time.
9) Permitted Use & Prohibited Conduct
You agree not to: (a) interfere with or disrupt the Services; (b) use bots/scrapers without written permission; (c) infringe intellectual property or privacy rights; (d) upload harmful code; (e) misrepresent your identity; or (f) use the Services for unlawful purposes.
10) Intellectual Property
All content, trademarks, logos, designs, and code on the Services are owned by or licensed to Taji Hijabs and protected by law. You may not copy, modify, distribute, or create derivative works without prior written permission.
11) Third-Party Services
We may rely on third parties (e.g., hosting, payment, analytics, shipping). Their services are governed by their own terms, and we are not responsible for them.
12) Disclaimers (No Warranties)
To the maximum extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, accurate, or free of errors.
13) Limitation of Liability (Near-Zero)
To the fullest extent permitted by law, we and our affiliates, directors, employees, and partners shall have no liability for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data; or costs of substitute goods/services, arising out of or related to your use of the Services or products—even if advised of the possibility of such damages.
If a court determines liability cannot be fully excluded, then our aggregate liability for any claims in the aggregate shall be the lesser of (i) the amount you paid us for the product giving rise to the claim, or (ii) USD $1.
14) Indemnification
You agree to defend, indemnify, and hold harmless Taji Hijabs from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Services.
15) Dispute Resolution; Class-Action Waiver
Individual Binding Arbitration. To the fullest extent permitted by law, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis, not in a class or representative action. No class actions or class arbitrations.
Governing Rules & Seat: The arbitration shall be conducted under the rules of Egypt.
Small Claims: Either party may bring an individual action in small-claims court if eligible.
If arbitration is not enforceable in your jurisdiction, disputes shall be resolved exclusively in the courts of Egypt.
16) Governing Law & Venue
These Terms are governed by the laws of Arab Republic of Egypt, without regard to conflict-of-laws principles. Subject to §15, courts in Egypt shall have exclusive jurisdiction.
17) Force Majeure
We are not liable for any delay or failure caused by events beyond our reasonable control, including acts of God, labor disputes, epidemic, war, embargo, internet or utility outages, or actions of carriers or authorities.
18) Changes to the Services or Terms
We may update the Services or these Terms at any time. Changes are effective upon posting with an updated “Effective Date.” Your continued use constitutes acceptance.
19) Miscellaneous
These Terms (together with the Privacy Policy and any policies referenced at checkout) are the entire agreement between you and us. If any provision is unenforceable, the remainder remains in effect. We may assign these Terms; you may not assign them without our consent. No waiver is implied by delay or failure to enforce.
